En pareil cas, on parle de mitoyennet\u00e9 ou de reconnaissance de limites.<br \/>\nDans certains cas deux murs privatifs peuvent \u00eatre accol\u00e9s et s\u00e9par\u00e9s par un espace infime qui fait limite ; dans d&rsquo;autres cas, un seul mur soutien les deux ouvrages. L\u2019alignement permet de v\u00e9rifier notamment les \u00e9ventuels empi\u00e9tements de riverains sur la voie publique mais \u00e9galement de v\u00e9rifier que le domaine public n&#8217;empi\u00e8te pas sur les propri\u00e9t\u00e9s priv\u00e9es. En revanche, la r\u00e9union am\u00e8ne \u00e0 une modification de la r\u00e9partition des charges qui devra \u00eatre vot\u00e9e \u00e0 la majorit\u00e9 de l\u2019article 24.<br \/>\nSi la r\u00e9union entra\u00eene des travaux sur des parties communes ou en modifie les conditions d\u2019acc\u00e8s, ceux-ci devront \u00eatre approuv\u00e9s \u00e0 la majorit\u00e9 de l\u2019article 25 ainsi que la r\u00e9partition des charges qui en d\u00e9coulera.<\/p>\n<\/div><div class=\"nav fusion-mobile-tab-nav\"><ul class=\"nav-tabs\"><li><a class=\"tab-link\" data-toggle=\"tab\" id=\"mobile-fusion-tab-privatisationdepartiescommunes\" href=\"#tab-65caaf9ff7aac9a1535\"><h4 class=\"fusion-tab-heading\">Privatisation de parties communes<\/h4><\/a><\/li><\/ul><\/div><div class=\"tab-pane fade fusion-clearfix\" id=\"tab-65caaf9ff7aac9a1535\">\n<p>Le principe consiste \u00e0 transformer un espace d\u00e9fini comme partie commune g\u00e9n\u00e9rale ou sp\u00e9ciale en partie privative. Le syndicat des copropri\u00e9taires vend cet espace \u00e0 un acqu\u00e9reur. Il y a donc lieu de modifier l\u2019\u00e9tat descriptif de division par la cr\u00e9ation d\u2019un lot suppl\u00e9mentaire auquel on affectera la quote-part des parties communes g\u00e9n\u00e9rales et sp\u00e9ciales qui convienne, le cas \u00e9ch\u00e9ant. Ce lot devra respecter la r\u00e9glementation en vigueur ainsi que les dispositions particuli\u00e8res du r\u00e8glement afin de ne pas porter atteinte \u00e0 la destination de l\u2019immeuble ni aux droits des autres copropri\u00e9taires.<br \/>\nPar exemple la privatisation d\u2019un couloir ne doit pas emp\u00eacher l\u2019acc\u00e8s \u00e0 d\u2019autres lots ou parties communes.<\/p>\n<p>La cr\u00e9ation d\u2019un lot est un acte de disposition et \u00e0 ce titre l\u2019approbation du modificatif sera vot\u00e9e en assembl\u00e9e g\u00e9n\u00e9rale \u00e0 la majorit\u00e9 de l\u2019article 26. C\u2019est par exemple le cas d\u2019une privatisation de portion de couloir. Dans le cas d\u2019un am\u00e9nagement de comble, il faudra \u00e9galement recueillir l\u2019accord du copropri\u00e9taire situ\u00e9 en dessous. De m\u00eame, la privatisation d\u2019un WC commun \u00e0 plusieurs copropri\u00e9taires devra obtenir l\u2019accord de l\u2019ensemble des titulaires d\u2019un droit sur ce WC.<br \/>\nSi l\u2019ali\u00e9nation d\u2019une partie commune (par exemple une loge avec suppression du service du concierge) porte atteinte \u00e0 la destination de l\u2019immeuble, ou \u00e0 l\u2019usage de copropri\u00e9taires, c\u2019est l\u2019unanimit\u00e9 qui est requise sauf si la suppression de ce service a \u00e9t\u00e9 pr\u00e9c\u00e9demment ent\u00e9rin\u00e9e. De plus, si l\u2019ali\u00e9nation a lieu sans contrepartie, l\u2019unanimit\u00e9 \u00e9viterait tout recours ult\u00e9rieur.<br \/>\nSi la cr\u00e9ation entra\u00eene des travaux sur des parties communes ou en modifie les conditions d\u2019acc\u00e8s, ceux-ci devront \u00eatre approuv\u00e9s \u00e0 la majorit\u00e9 de l\u2019article 25 ainsi que la r\u00e9partition des charges qui en d\u00e9coulera.<\/p>\n<\/div><div class=\"nav fusion-mobile-tab-nav\"><ul class=\"nav-tabs\"><li><a class=\"tab-link\" data-toggle=\"tab\" id=\"mobile-fusion-tab-nouveller\u00e9partitiondescharges\" href=\"#tab-5ed689cadf4846cf053\"><h4 class=\"fusion-tab-heading\">Nouvelle r\u00e9partition des charges<\/h4><\/a><\/li><\/ul><\/div><div class=\"tab-pane fade fusion-clearfix\" id=\"tab-5ed689cadf4846cf053\">\n<p>L\u2019article 12 de la loi du 10 juillet 1965 pr\u00e9voit que tout copropri\u00e9taire peut demander la r\u00e9vision des charges :<br \/>\n\u2022 dans un d\u00e9lai de cinq ans de la publication du r\u00e8glement de copropri\u00e9t\u00e9<br \/>\n\u2022 ou dans les deux ans suivant la premi\u00e8re vente du lot concern\u00e9 s\u2019il constate un \u00e9cart de plus du quart sur son lot ou celui d\u2019un voisin.<br \/>\nLa jurisprudence a reconnu \u00e9galement le droit \u00e0 tout copropri\u00e9taire \u00e0 agir en nullit\u00e9 de la r\u00e9partition des charges sans prescription de d\u00e9lai s\u2019il est reconnu que la r\u00e9partition des charges ne respecte pas les dispositions de l\u2019article 10 d\u2019ordre public fixant la r\u00e9partition des charges g\u00e9n\u00e9rales comme celles d\u2019\u00e9quipements communs.<br \/>\nDans un cas comme dans l\u2019autre, ces actions en r\u00e9vision ou en annulation de la r\u00e9partition des charges sont intent\u00e9es par le copropri\u00e9taire devant le Tribunal de grande instance.<\/p>\n<p>Pr\u00e9alablement \u00e0 ces proc\u00e9dures, l\u2019assembl\u00e9e g\u00e9n\u00e9rale peut d\u00e9cider dans un contexte amiable de confier une mission d\u2019\u00e9tude d\u2019une nouvelle r\u00e9partition des charges \u00e0 un g\u00e9om\u00e8tre-expert. La mission d\u2019\u00e9tude sera vot\u00e9e \u00e0 la simple majorit\u00e9 de l\u2019article 24.<br \/>\nLe g\u00e9om\u00e8tre-expert proc\u00e9dera \u00e0 un mesurage complet de la copropri\u00e9t\u00e9 pour assurer la fiabilit\u00e9 et la qualit\u00e9 de ce nouveau calcul. Il proposera une grille de r\u00e9partition des charges g\u00e9n\u00e9rales, bas\u00e9e sur les dispositions des articles 5 (consistance, situation et superficie) et 10, grille qui sera diff\u00e9rente des quotes-parts de propri\u00e9t\u00e9 qui resteront intangibles.<br \/>\nLa nouvelle r\u00e9partition des charges n\u00e9cessite un vote de l\u2019assembl\u00e9e des copropri\u00e9taires \u00e0 l\u2019unanimit\u00e9 (article 11).<\/p>\n<\/div><div class=\"nav fusion-mobile-tab-nav\"><ul class=\"nav-tabs\"><li><a class=\"tab-link\" data-toggle=\"tab\" id=\"mobile-fusion-tab-divisionenvolumes\" href=\"#tab-bb898d769baac615d98\"><h4 class=\"fusion-tab-heading\">Division en volumes<\/h4><\/a><\/li><\/ul><\/div><div class=\"tab-pane fade fusion-clearfix\" id=\"tab-bb898d769baac615d98\">\n<p>Le g\u00e9om\u00e8tre-expert \u00e9tablit les documents n\u00e9cessaires \u00e0 la gestion des ensembles immobiliers complexes, dont une partie de la propri\u00e9t\u00e9 peut relever de la domanialit\u00e9 publique. Pour cela, il identifie les diff\u00e9rents volumes composant l&rsquo;ensemble \u00e0 l\u2019aide de plans et coupes \u00e9tablis \u00e0 partir de levers r\u00e9guliers (b\u00e2timents existants) ou de documents fournis par le ma\u00eetre d\u2019ouvrage (immeubles en vente en l&rsquo;\u00e9tat futur d&rsquo;ach\u00e8vement).
